LABOUHEYRE (Landes). A handwritten memorandum concerning the rights of franc-fief, the quest, and the seigneurial customs of the baronies of Labouheyre, Herbe-Favière, and Sabres. Folio-sized manuscript, 4 handwritten pages on laid paper, dated Bordeaux, March 10, 1763, with reference to a Council ruling of December 26, 1762. 18th-century cursive script. Old folds, small marginal tears, and normal wear and tear without significant damage to the text. An important legal brief drafted in the context of a dispute between the residents and mill owners of the lands of Labouheyre, Herbe-Favière, and Sabres and the administration responsible for collecting franc-fief duties. The text examines local custom, the seigneurial rights attached to the “quête,” the obligations of the inhabitants, and the legal nature of the tenures in question. In particular, the brief cites the custom of Dax, Parliamentary rulings, and various ancient documents to demonstrate that the inhabitants enjoyed a traditional right to take possession of vacant lands upon payment of the “quête” to the lord. It provides a particularly interesting account of land structures and customary practices in the Landes region under the Ancien Régime. A primary source for the local history of the Grande Lande, the study of Gascon customary law, and the evolution of relations between rural communities and seigneurial authority on the eve of the Revolution.
